Notice of Amendments to the Octopus Automatic Add-Value Agreement and Change of Name


Octopus Cardholders who are using the Octopus Automatic Add-Value Service should note that Creative Star Limited ("Creative Star"), the issuer of Octopus cards, will change its name to "Octopus Cards Limited" on 2nd January 2002 and will be amending the Octopus Automatic Add-Value Agreement ("AAV Agreement") at the same time.

The purposes of the key changes are as follows:

to make sure Creative Star exercises its discretions under the AAV Agreement in a fair way;
to make it clear that (i) the person ("Account Holder") whose account will be debited ("Designated Account') under the AAV Agreement does not need to be the Octopus Cardholder and (ii) if the Account Holder is not the same as the Cardholder, both the Account Holder and the Cardholder shall be jointly and severally liable for sums payable to Creative Star under the AAV Agreement;
to permit Cardholders to use a non-bank credit card account as the Designated Account; and
to clarify that Creative Star may (i) charge a reasonable administration fee if any instructions of Creative Star to debit the Account Holder's Designated Account are not honoured and (ii) apply the Card Deposit and any remaining value in a Card in payment of any amounts of money payable by the Account Holder and the Cardholder to Creative Star.

The above is a summary only of the key changes to the AAV Agreement and is not an exhaustive list of all the changes. Other changes are mainly stylistic or for the purpose of simplification or clarification.

The revised AAV Agreement is set out below in full and the changes from the existing form are highlighted. Copies of the revised AAV Agreement will be available at every MTR Station, KCR East Rail Station, KCR Light Rail Customer Service Centre, and from Creative Star direct starting from 29th November, 2001. The revised AAV Agreement can also be downloaded from the website of Creative Star (www.octopuscard.com).

The revised AAV Agreement comes into effect on 2nd January, 2002.

If any Octopus Cardholder or Account Holder does not accept the revised AAV Agreement, he or she may apply for cancellation of the Automatic Add-

Value Service by surrendering the Personalised Octopus card to Creative Star before 2nd January, 2002 for processing. The Personalised Octopus card shall be returned to the Cardholder after the processing has been completed.
